CON101 | Contracts I

Making a contract is a very common activity and part of our everyday experience e.g. selling and buying, banking, travelling etc. This Course deals comprehensively with the basic principles of law of Contracts, with special reference to Indian Contract law. Introduction to the laws of obligations with the foundation of legal liability in contract shall be the focus area for this course.
Further, Law of contracts is not just about contracts but is an introduction to legal reasoning and method. It is fundamental to how a person starts thinking as a lawyer. The development of this skill in the students will also be the focus of this course.

Contract Law I is a core course mandated by Bar Council and UGC and is a Foundational Course in law of contracts.

Approach:

The Contracts-I Course syllabus mainly comprises of the general principles of the law governing enforceable agreements. The principal topics that will be discussed during the course include: the process and legal rules related to formation of agreements; the legal requirements which must be satisfied to make agreements legally enforceable or vitiate their legal enforcement such as capacity, consent, consideration, mistake, misrepresentation, undue influence etc.; Performance and breach of Contract; Privity of contract; Quasi Contracts; contractual terms and the implication of terms; principles relating to the discharge of contracts; remedies for breach of contract by way of damages, liquidated damages, specific performance and injunction.

Course Outcome: Students will have a broad understanding of the principles of the law of contract and be able to demonstrate their application to the essentials of formation, performance and discharge of contractual obligations in commercial situations.

Teaching Method: The Course will be taught by delivering Lecture, engaging the students in class room discussion and case law analysis using Socratic Method and in addition a response paper will be given after completion of 1st module. Two movies will also be screened for the Students – 1^st movie screening – before the mid-terms, 2^nd movie Screening – before the end-term examinations.

The Course is divided into 3 Modules to be taught over a period of 10 weeks. Module 1 deals with formation of Contracts, Module 2 Deals with Performance, Discharge and Restrictions on Contracts and Module 3 deals with Discharge, Breach and Quasi-Contracts.
