In the light of significant developments of IPR regime at the International level and the adoption of National Intellectual Property Rights Policy of 2016 in India as well as with the integration of IPR policy into all other policies of the Government, Business entities, Research organisations, creative industries and other Institutions, understanding of Intellectual Property Rights is indispensable. In this context, this course, ‘Law of Intellectual Property Rights’ has been designed by the course teacher for the B.A LL.B [Hon.] candidates to offer an insight into the fundamental principles underlying the protection of various categories of Intellectual Property Rights, with an emphasis on Patents, Copyrights, Trademarks, Designs and Geographical Indications. The candidates will be introduced to the International regime of IPR. The emphasis shall be on the nature and extent of rights which the IPR holder gets by virtue of the legal protection and enforcement of those rights. The course will examine IPR from the perspective of its interface with other disciplines such as right to education, right to health, public interest, standards or competition law. The IP jurisprudence from other jurisdictions will be brought in to understand the principles, such as basic concepts, rights, tests for infringement. The procedure for registration/grant of relevant IPRs, both at national and international level shall be examined.
The objective of this course is to enable the candidates to determine the type of protection available to different categories of IPRs, the duration and extent of the same and how IPR holder can strategically utilise IPR for his/society’s benefit . The course aims at making the candidates familiar with the procedure for obtaining the protection and the remedies available in case of infringement of the conferred rights. The course attempts to provide updated and advanced information regarding the developments taking place at national and international level in the field of IPR.
The methodology adopted for the course will be lecture-cum-discussion, requiring the candidates to read the relevant portion of the study materials and assigned articles/cases prior to the classes and participate actively in the discussion. Case/article presentation by the candidates will be encouraged. In addition to the printed reading material other relevant articles and cases will be forwarded periodically to the candidates through e-mails. Guest lectures shall be organized for the purpose of giving an insight to practical aspects.
