This course is a seminar. It develops on Family law, which is a core course, mandated by the Bar Council of India.
Describe how you have approached the course: Each module deals with a core topic in family law. The seminar will go beyond the doctrinal understanding of the topic and critically analyse the underlying principles of the law from a theoretical and comparative lens. Discussions on every topic will start from the law as it is in India (through statute/case law), focusing on what the position of law reveals about its assumptions and objectives. Students will then be given an overview of different principles upon which laws may be based, encouraging them to think about whether, and in what way, Indian law requires reform.
Describe your pedagogical method: Each module will begin with a brief discussion on the position of law in India, followed by a set of questions raised by the course teacher. These questions will then be sought to be answered through a seminar style discussion of the assigned readings (to be sent in advance). The discussion will be moderated by the course teacher, and oriented towards answering the questions raised at the beginning of the class. Any doubts/clarifications will be taken up and answered in the course of the discussion.
