This course is an advanced course in criminal law, which will examine certain contemporary debates in substantive and procedural criminal law. Completion of basic courses in substantive and procedural criminal law is a pre-requisite for the course. It aims to build on concepts learnt by students in their core courses in criminal law. The focus of the course is to critically engage with questions that have been in the forefront over the last few years, and to examine case law and literature (where available on these issues). Issues to be discussed include the use of criminal law in regulating reproductive choices, issues in regulating speech considered to be offensive, and questions on sentencing jurisprudence of Indian courts. Being an elective course, the course will be reading-heavy, with a focus on close and critical reading of assigned materials.
