The Course titled as Online Dispute Resolution through Mediation is a new facet of Alternative Dispute Resolution a Compulsory clinical Course in a legal education as prescribed under Part II Schedule I Paper 23 of Rules of Legal Education, 2008. Settlement of disputes in an amicable way is the hall-mark of civilization. In ancient India, mediation system has been prevalent in one form or the other. It has continued in our villages and has
also been preserved in its customary form in our tribal areas. So far as formal litigation system is concerned, mediation, along with other methods of Alternative Disputes Resolution, has been statutorily recognized by the Civil Procedure Code (Amendment) Act, 1999 which introduced section 89.
An idea of the immense value that mediation imbibes in it can be had by separately treating the wide array of unique features clustered under the mediation rubric and in the meantime The “Digital India” movement is taking its shape in high speed than what was expected and it can further change the way of trade and business along with the way of resolving the disputes. The impact of COVID-19 has also paved a way for the resolution of disputes through online mode. The choices of materials are both primary readings as well as secondary readings. The primary source such as Statues, Rules, Regulations, case laws, national survey etc., whereas Secondary reading are Articles, Books etc.,
The course is designed to adopt the Lerner centric method as well as High-tech approach of learning where the students can actively participate and teacher would play a role of facilitator. During the seminar students will listen to lectures, videos and guest lectures and Further the students will be trained through ONLINE MEDIATION simulation exercise & drafting
