This course develops on the core arbitration law course taught at Law School. We have  identified certain controversial issues that have frequently engaged the attention of Indian  courts and arbitration practitioners in India. On some of these issues, the law is still unsettled;  on some others, the present position may not be wholly satisfactory. In this course, we intend  to look at the development of law on these issues; why these issues have been controversial;  whether the approach adopted by the Indian courts has been consistent with general principles  of arbitration law and international practice; any gaps in the law and the way forward.

The course will involve a combination of lectures and discussions. The relevant general  principles and case law will be introduced through lectures as well as case presentations by  students. This will be followed by discussions. The readings will include mainly case law and  articles.
